Arizona rules

What changes here.

Every coverage page on this site is written for all the states we serve. These are the rules that differ in this one.

  1. 01

    Workers' comp

Required for any employer with one or more employees (A.R.S. §23-902). An uninsured employer can be sued directly by an injured worker without the usual defenses, must repay any benefits the state’s Special Fund pays plus a penalty of 10% or $1,000, whichever is greater, and faces civil penalties of up to $1,000, rising to $5,000 and $10,000 for repeat failures within five years. The Industrial Commission can also ask a court to stop the business operating until it is covered.

  2. 02

    Auto minimum limits

25/50/15 since July 1, 2020: $25,000 per person and $50,000 per accident for bodily injury, and $15,000 for property damage. Driving uninsured can cost you your registration or your license.

  3. 03

    Contractor licensing

A Registrar of Contractors (ROC) license needs a bond sized by license type and yearly volume: $4,250 to $15,000 for residential work and $2,500 to $100,000 for commercial. Contractors with employees must carry workers’ comp. Beyond that the ROC requires no insurance to license, so general liability is set by your contracts and your own risk, not the license.

  4. 04

    Home market

In forested and wildland areas some carriers have pulled back. When no Arizona-licensed carrier will write a home, the next step is the surplus lines market, which the law allows only after a diligent search of licensed carriers. Surplus lines policies carry fewer consumer protections and some exclude wildfire, so read them closely; we will.

  5. 05

    Trucking filings

Carriers that operate only inside Arizona still need a USDOT number for vehicles of 10,001 pounds or more, or for hazardous materials that need a permit (Arizona rule R17-5-203).

Everything else is the same.

The rest of the site applies here too: more than one carrier at every renewal, the policy read in plain English, and the same people answering the phone.
